you grant Stay Ready Outdoors, LLC a perpetual, worldwide, royalty-free, transferable, sublicensable, non-exclusive license to use, reproduce, modify, distribute, publish, display, and create derivative works from such content for business, marketing, promotional, and operational purposes.

You represent and warrant that:

• You own the content or possess sufficient rights to submit it.

• The content does not infringe any third-party rights.

• The content complies with applicable laws.

We reserve the right to reject, remove, refuse, or cancel any order involving content we believe may violate intellectual property rights or applicable law.

8. PRODUCT AVAILABILITY, PRICING, AND ORDER ACCEPTANCE

All product descriptions, specifications, availability, lead times, and pricing are subject to change without notice.

Submission of an order does not constitute acceptance of that order.

We reserve the right to refuse, cancel, limit, or modify any order at any time.

Reasons may include, but are not limited to:

Fraudulent chargebacks, knowingly false claims, abuse of payment dispute procedures, or attempts to retain products while obtaining a refund may result in:

• Account termination

• Refusal of future service

• Collection efforts

• Recovery of associated fees and costs where permitted by law

10. SHIPPING AND RETURNS

Shipping, delivery estimates, return eligibility, freight exceptions, cancellations, refunds, and restocking fees are governed by our Shipping Policy and Return & Refund Policy, both of which are incorporated into these Terms by reference.

11. ASSUMPTION OF RISK AND PRODUCT USE

Many products sold by Stay Ready Outdoors involve inherent risks and may cause injury, death, property damage, or financial loss if improperly used.

Examples include:

• Fire-starting equipment

• Survival equipment

• Recovery gear

• Medical equipment

• Vehicle-mounted equipment

• Communications equipment

• Lithium battery products

• Outdoor and expedition equipment

By purchasing, possessing, or using such products, you acknowledge and agree that:

• You assume all risks associated with their use.

• You will obtain appropriate training where applicable.

• You will follow manufacturer instructions.

• You will use products only in lawful and intended manners.

• You accept full responsibility for use of the products.

11A. MEDICAL DISCLAIMER

Medical supplies, trauma kits, medications, first aid products, educational materials, and survival kits sold by Stay Ready Outdoors are intended for preparedness and emergency response purposes only.

Nothing sold or published by Stay Ready Outdoors constitutes medical advice, diagnosis, treatment, or professional healthcare services.

Customers are solely responsible for obtaining appropriate training and consulting qualified medical professionals.

11B. RECOVERY EQUIPMENT DISCLAIMER

Vehicle recovery operations involve significant hazards.

Customers assume all risks associated with the use of recovery equipment, including kinetic ropes, shackles, winches, jacks, recovery boards, lifting devices, and related equipment.

Stay Ready Outdoors shall not be liable for injuries, death, property damage, or losses arising from improper use, misuse, overloading, equipment modification, improper rigging, or failure to follow manufacturer instructions.

11C. VEHICLE EQUIPMENT DISCLAIMER

Products intended for installation on vehicles must be properly installed and maintained.

Customers are solely responsible for:

• Verifying compatibility

• Proper installation

• Compliance with applicable laws

• Safe operation

Stay Ready Outdoors is not responsible for damages resulting from installation errors, misuse, modification, or incompatibility.

11D. COMMUNICATIONS EQUIPMENT COMPLIANCE

Certain communications products may require licensing, authorization, certification, programming restrictions, or compliance with applicable FCC regulations.

Customers are solely responsible for complying with all applicable communications laws and regulations.

11E. CUSTOM PRODUCTS, PROCUREMENT SERVICES, AND AGENCY ORDERS

Stay Ready Outdoors and LYNX Survival Systems may provide:

• Custom-built kits

• Procurement services

• Agency equipment sourcing

• Product configuration services

• Consultation services

Component availability, lead times, specifications, and product offerings may change due to supplier conditions, discontinuations, shortages, or other factors beyond our control.

We reserve the right to substitute substantially equivalent components when necessary.

12. COMPLIANCE WITH LAWS

You are solely responsible for complying with all local, state, federal, and international laws applicable to products purchased from us.

This includes laws governing:

• Vehicle equipment

• Medical products

• Hazardous materials

• Export-controlled products

By placing an order, you represent that your purchase and intended use are lawful.

13. WARRANTIES AND DISCLAIMER

• MERCHANTABILITY

• FITNESS FOR A PARTICULAR PURPOSE

• NON-INFRINGEMENT

• ACCURACY

• AVAILABILITY

We do not warrant uninterrupted, secure, or error-free operation.

14. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, STAY READY OUTDOORS, LLC, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, AFFILIATES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

THIS INCLUDES, WITHOUT LIMITATION:

• LOSS OF PROFITS

• LOSS OF REVENUE

• LOSS OF DATA

• LOSS OF BUSINESS

• LOSS OF GOODWILL

• PERSONAL INJURY

• PROPERTY DAMAGE

• EMOTIONAL DISTRESS

• INTERRUPTION OF OPERATIONS

14A. LIABILITY CAP

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF STAY READY OUTDOORS ARISING FROM ANY CLAIM SHALL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT ACTUALLY PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM; OR

(B) $100.00 USD.

15. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Stay Ready Outdoors, LLC, its owners, employees, officers, affiliates, contractors, suppliers, and agents from and against all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of:

• Your use or misuse of products

• Your violation of these Terms

• Your violation of applicable law

• Your infringement of third-party rights

16. FORCE MAJEURE

We shall not be liable for delays or failures resulting from events beyond our reasonable control, including:

• Natural disasters

• Acts of government

• Supply chain disruptions

• Labor disputes

• Carrier delays

• Cyberattacks

• Internet outages

• Utility failures

• War

• Civil unrest

17. EXTERNAL LINKS

The Site may contain links to third-party websites.

We are not responsible for third-party content, policies, services, products, or practices.

18. EXPORT COMPLIANCE

Customers agree to comply with all applicable United States export laws and regulations.

Products may not be exported, re-exported, transferred, or resold in violation of U.S. law.

19. TERMINATION

We reserve the right to suspend, restrict, or terminate access to the Site or services at any time and for any reason.

Any obligations or liabilities incurred prior to termination shall survive termination.

20. SEVERABILITY

21. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between the parties and supersede all prior agreements, communications, and understandings.

22. GOVERNING LAW AND VENUE

These Terms shall be governed by and construed under the laws of the State of California.

Any dispute, claim, or controversy arising from or relating to these Terms, the Site, products, or services shall be brought exclusively in the state or federal courts located in Los Angeles County, California.

Each party consents to the exclusive jurisdiction of those courts.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL.
